These Terms and Conditions of Usage, along with any applicable additional terms or agreements listed or stated below (collectively, the “Terms and Conditions”) govern your use of the and access to our websites, web-based applications and products, customer support and related documents.

The Terms and Conditions are in place for a trustful relationship between us as a supplier and service provider, and you as the customer and user, so that you can experience a great customer relationship.

BY ACCEPTING THISE TERMS AND CONDITIONS, BY CLICKING THE BOX INDICATING YOUR ACCEPTANCE, YOU HAVE AGREED TO EVERYTHING STATED BELOW. IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY AND ITS AFFILIATES TO THIS AGREEMENT, IN WHICH CASE THE TERMS “YOU” OR “YOUR” SHALL REFER TO SUCH ENTITY AND ITS AFFILIATES. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS (AS DEFINED BELOW), YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICES.

The Terms and Conditions was last updated on January 2nd, 2024. These Terms and Conditions replace and supersede all prior versions. It is effective between You and Us as of the date You accepted these Terms and Conditions.

110 alarm transmission service - acceptance of third party Terms
If you choose to include Elotec's 110 alarm transmission service in your subscription, which entails automatic alarm transmission to the local fire emergency services, Elotec will transfer the request, along with any necessary registration information, to the 110 central covering your region.

By accepting these Terms and Conditions, you also acknowledge and agree to be bound by the terms of the specific 110 central and the local fire brigade for your region, hereafter "Third-Party Terms") which are listed in the end of this document by reference. Your acceptance of the Third-Party terms means that you enter into a contractual relationship directly with the 110 central. Your acceptance of the Third-Party Terms is a prerequisite for utilizing the services offered by Elotec that entail automatic alarm transmission to the local fire emergency services.

It is your responsibility to review and understand the Third-Party Terms before accepting these Terms and Conditions. The applicable Third-Party Terms and the price list are available at the specific 110 central. The applicable privacy policy which explains how the 110 central processes your personal data under the Third-Party Terms. The 110 central or the fire brigade might also contact you directly for any additional information needed or agreement.  

Changes to the Terms and Conditions
Elotec reserves the right to modify the Terms and Conditions of the agreement with 30 (thirty) days’ notice. We also have the right to cancel, modify, suspend or terminate the Service, fully or on in part after having notified the User at least 30 (thirty) days preceding the cancellation of Service. Elotec reserves the right to change the prices of recurring subscriptions. Changes will take effect 30 (thirty) days after notification.
 

Privacy and data processing
Elotec AS ("Elotec", "we" or "us") may collect personal data processed in connection with the Elotec platform and alarm transmission system Elotec Orion ("Elotec Orion", the “Services”). "Personal data" means any information relating to an identified or identifiable natural person, such as name, location data, phone number, IP-address or a combination of these that make it possible to identify the person to whom the data belongs, ref. Article 4(1) of the EU General Data Protection Regulation (the "GDPR"). This information may be used by Elotec, acting as Data Controller, according to our Privacy Policy. When we act as Data Controller, this means that we determine the purposes and means of the processing of personal data. Data related to your installed sensors and system may be shared with the same third party who sold you the Elotec Orion alarm transmission hardware, who in turn may use the data to offer customer and technical support services, according to our Privacy Policy and the Data Processing Agreement (as stated below).

Renewals, cancellation, and termination
Subscriptions are automatically renewed when the current subscription period ends.

The agreement for alarm transfer kan be terminated by both the customer and by Elotec, with a mutual termination periode of 3 - three - months written notice. The termination periode starts from the 1st in the following month. The End User owning the alarm transmitter can cancel the subscription at any time. When a subscription is cancelled, it means that it will not be renewed at the end of the subscription period.

After a subscription ends, Elotec will terminate the account, saved data may also be deleted in this process unless other is stated in the privacy policy and data processing agreement.

If the subscription holder has failed to pay fees or other subs owed to Elotec, we have the right to terminate the account 90 days after the original payment was due.

Elotec has the right to terminate the user’s account if the user acts in a manner that is not compliant with this agreement, or the instructions given by Elotec.

Elotec has the right to invoice a fee for use beyond what the system is intended for, or excessive use of data and SMS. For a standard subscription, 10 pcs SMS is included per month.

Account usage, activity, and security
You as the user are responsible for all activity that occurs using your account. You are responsible for taking the needed steps to maintain the security and control of your account. We reserve the right to monitor and enforce subscription plan limits and restrictions, including, but not limited to, the right to charge for usage superseding the limits and restrictions.

Elotec may establish or amend general operating practices to ensure that the Services are available and not abused.
You must use the Services responsibly and not misuse them, for example you must not:
use without, or in violation of the Terms and Conditions.
copy, modify, host, sublicense or resell the Services or your account.
enable or allow others to use the Services with your account.
access or attempt to access the Services by any means other than the interface we provide.
circumvent any access or use restrictions put in place to prevent certain uses of the Services.
use the Services or Software if You are Our direct competitor, except with Our prior written consent.
access the Online Services for the purposes of monitoring its availability, performance, or functionality, or for any other benchmarking or competitive purposes.

Adding additional users to a Elotec Orion installation
The End User may share the access to the installed alarm transmitters as long as there is a valid subscription in place for this hardware. To enable this access the End User that owns the installation in question need to send a written request to Elotec. The request need to verify the identity of the End User, to specify the scope of the access and that the End User assumes responsibility for the invited users and their use of the Services. The End User can also invite additional users in the Elotec Orion/IOT application with the same responsibilities.

Elotec reserves the right to monitoring the alarm transmission hardware for statistical purposes.

These Terms and Conditions are governed by Norwegian law and disputes between you and Elotec relating to these Terms and Conditions shall be settled at Trøndelag District Court (Trøndelag tingrett).
